O R D E R

The Canadian International Trade Tribunal, under the provisions of section 76 of the Special Import Measures Act, has received representation on behalf of Bekaert Corporation, an importer of the subject goods, to conduct a review of the finding of the Anti-dumping Tribunal dated May 13, 1981, concerning brass coated carbon steel wire for reinforcing high pressure hose originating in or exported from Belgium and Spain in Inquiry No. ADT-1-81 and continued without amendment in Review No. R-3-86 dated on September 26, 1986.

Pursuant to subsection 76(4) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby rescinds the above-mentioned finding of May 13, 1981, which was continued without amendment on September 26, 1986, effective July 1, 1989.

STATEMENT OF REASONS

On June 2, 1989, the Canadian International Trade Tribunal (the Tribunal) received from Bekaert Corporation (Bekaert) a request for review of a finding issued by the Anti-dumping Tribunal on May 13, 1981, respecting brass coated carbon steel wire for reinforcing high pressure hose originating in or exported from Belgium and Spain (ADT-1-81) which was continued without amendment on September 26, 1986, in Review No. R-3-86. The grounds advanced by Bekaert are that the sole domestic producer of these goods, National-Standard Company of Canada (National-Standard), was discontinuing production of the subject goods in Canada at the end of June 1989.

Information obtained by the Tribunal from National-Standard, subsequent to Bekaert's request, confirmed that the domestic producer was phasing out production of hose wire in Canada commencing July 1, 1989. In light of the foregoing, the Tribunal issued a Notice of Review on July 24, 1989 (as revised on July 27, 1989), to all known interested parties which read, in part, as follows:

In view of the imminent cessation of Canadian production of these goods, the Tribunal wishes to have the views of interested parties on why this finding should not be rescinded on July 1, 1989, or at such later date as the Tribunal may determine.

The Notice of Review was published in Part I of the August 5, 1989, edition of the Canada Gazette. The deadline for filing submissions was August 25, 1989.

The only submission received further to the Notice of Review was from Goodyear Canada Inc. (Goodyear), the major domestic user of the subject goods. Goodyear's submission supports the rescission of the finding.

The Tribunal notes that the domestic industry has not contested the request to rescind the finding and has presented no views, further to the Notice of Review, as to why the effective date of rescission should not be July 1, 1989, the day on which National-Standard's production phase-out commences. Accordingly, the Tribunal hereby rescinds the finding effective July 1, 1989.
