IN THE MATTER OF a preliminary injury inquiry, pursuant to subsection 34(2) of the Special Import Measures Act, respecting:
Polyethylene Terephthalate
PRELIMINARY DETERMINATION OF INJURY
The Canadian International Trade Tribunal, pursuant to the provisions of subsection 34(2) of the Special Import Measures Act (SIMA), has conducted a preliminary injury inquiry into whether there is evidence that discloses a reasonable indication that the dumping and subsidizing of polyethylene terephthalate (“PET”) resin having an intrinsic viscosity of at least 0.70 deciliters per gram but not more than 0.88 deciliters per gram, including PET resin that contains various additives introduced in the manufacturing process, as well as blends of virgin PET resin and recycled PET, originating in or exported from the People’s Republic of China and the Islamic Republic of Pakistan, and excluding 100% recycled PET resin (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.
This preliminary injury inquiry follows the notification, on March 19, 2025, that the President of the Canada Border Services Agency had initiated investigations into the alleged injurious dumping and subsidizing of the subject goods.
Pursuant to subsection 37.1(1) of SIMA, the Tribunal determines that there is evidence disclosing a reasonable indication that the dumping and subsidizing of the subject goods have caused injury.
