Inquiry NQ-2025-002 Polyethylene Terephthalate |
Finding issued |
IN THE MATTER OF an inquiry pursuant to section 42 of the Special Import Measures Act respecting:
POLYETHYLENE TEREPHTHALATE
FINDING
The Canadian International Trade Tribunal, pursuant to the provisions of section 42 of the Special Import Measures Act (SIMA), has conducted an inquiry to determine whether the dumping of polyethylene terephthalate (“PET”) resin having an intrinsic viscosity of at least 0.70 deciliters per gram but not more than 0.88 deciliters per gram, including PET resin that contains various additives introduced in the manufacturing process, as well as blends of virgin PET resin and recycled PET, originating in or exported from the People’s Republic of China (China) and the Islamic Republic of Pakistan (Pakistan), excluding 100% recycled PET resin, and the subsidizing of the above‑mentioned goods from China, have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Further to the Tribunal’s inquiry, and following the issuance by the President of the Canada Border Services Agency of a final determination dated September 15, 2025, that the above‑mentioned goods from Pakistan have been dumped and that those from China have been dumped and subsidized, the Tribunal finds, pursuant to subsection 43(1) of SIMA, that the said dumping and subsidizing have caused injury to the domestic industry.
The Tribunal further finds that the circumstances referred to in paragraphs 42(1)(b) and (c) of SIMA relating to massive importation are not present.
