IN THE MATTER OF an appeal filed under section 67 of the Customs Act, R.S.C., 1985, c. 1 (2nd Supp.);

AND IN THE MATTER OF a letter dated May 20, 2015, from the Canadian International Trade Tribunal directing GrimmWorks Inc. to provide reasons why the Canadian International Trade Tribunal should not dismiss the appeal pursuant to paragraph 29(c) of the Canadian International Trade Tribunal Rules.

ORDER

WHEREAS the above-noted appeal was filed by GrimmWorks Inc. (GrimmWorks) on February 27, 2015, under section 67 of the Customs Act;

AND WHEREAS GrimmWorks is not represented by counsel on the appeal;

AND WHEREAS, by letter dated February 27, 2015, the Canadian International Trade Tribunal (the Tribunal) directed GrimmWorks to file a brief by April 28, 2015;

AND WHEREAS, by letter dated April 30, 2015, the Tribunal directed GrimmWorks to file its brief immediately and indicated that, should the Tribunal not receive any written communication from GrimmWorks by May 15, 2015, the Tribunal could dismiss the appeal without further notice;

AND WHEREAS, by letter dated May 20, 2015, the Tribunal directed GrimmWorks to provide the Tribunal with reasons why the appeal should not be dismissed and informed GrimmWorks that failure to respond to the request would result in the appeal being dismissed;

AND WHEREAS a representative of GrimmWorks left one voice message with the Tribunal on May 25, 2015, but has failed to return the Tribunal’s subsequent return voice messages left on May 26 and 27, 2015;

AND WHEREAS the Tribunal has received no written reply to any of the above letters and, to date, GrimmWork’s brief has not been filed as directed by the Tribunal;

THEREFORE, the Tribunal hereby orders that the above-noted appeal be dismissed pursuant to paragraph 29(c) of the Canadian International Trade Tribunal Rules.
