IN THE MATTER OF an application made by 1349094 Ontario Inc. d.b.a. Oakville Home Leisure, pursuant to section 67.1 of the Customs Act, for an order extending the time to file a notice of appeal pursuant to section 67 of the Customs Act with respect to decisions dated July 7, 2022, issued by the President of the Canada Border Services Agency.

ORDER

Having considered the submissions of 1349094 Ontario Inc. d.b.a. Oakville Home Leisure, having noted that the Canada Border Services Agency (CBSA) takes no position regarding the application, and being satisfied that the requirements and conditions set out in section 67.1 of the Customs Act have been met;

The Canadian International Trade Tribunal orders as follows:

  • the time to file a notice of appeal pursuant to subsection 67(1) of the Customs Act is extended with regard to the 11 decisions of the President of the CBSA issued on July 7, 2022, concerning transactions 19497003888793, 19497004132187, 19497004241544, 19497004288243, 19497004292261, 19497004408157, 19497004412302, 19497004540181, 19497004587427, 19497004652984, and 19497004150306;

  • the documents filed by 1349094 Ontario Inc. d.b.a. Oakville Home Leisure on October 17, 2022, are accepted as a notice of appeal, pursuant to subsection 67(1) of the Customs Act;

  • the appeal thus constituted is joined to appeal AP-2022-022 (filed with respect to the CBSA’s decision dated July 13, 2022, regarding transaction 19497003888806); and

  • the Registrar of the Tribunal will communicate with the parties, and new time limits for proceeding with appeal AP-2022-022 will be determined depending on the circumstances; furthermore, a new hearing date will be set if the parties demonstrate that the joining of the new appeal requires a postponement of the hearing on May 11, 2023.
