ORDER

The Canadian International Trade Tribunal grants the motion in part.

Having reviewed the notice of motion for the production of documents filed by Pomerleau Inc. dated March 13, 2015, the submissions by the Department of Public Works and Government Services dated March 19, 2015, the submissions by Brookfield Johnson Controls Canada LP dated March 19, 2015, and the reply by Pomerleau Inc. dated March 23, 2015, the Canadian International Trade Tribunal orders the Department of Public Works and Government Services, pursuant to subsection 17(2) of the Canadian International Trade Tribunal Act, to file with the Canadian International Trade Tribunal, no later than Friday, April 10, 2015, the following documents:

  • documents referred to in paragraph 19 of the submissions by the Department of Public Works and Government Services dated March 19, 2015;
  • Building Management Plan call letter;
  • Building Management Plan;
  • Implementation Strategy Study of the Department of Public Works and Government Services for the Carling Campus Project;
  • Implementation Strategy Report;
  • Implementation Strategy Presentation;
  • Project Management Plan;
  • Carling Phase 1 Work Breakdown Structure; and
  • High-level Work Breakdown Structure.

Pomerleau Inc. is directed to file its comments, if any, on these documents by Thursday, April 16, 2015. The Department of Public Works and Government Services and Brookfield Johnson Controls Canada LP are directed to file their responses, if any, to the comments filed by Pomerleau Inc. by Tuesday, April 21, 2015. Pomerleau Inc. is directed to file its reply to the responses of the Department of Public Works and Government Services and Brookfield Johnson Controls Canada LP, if any, by Friday, April 24, 2015.

If the documents or submissions contain information which the Department of Public Works and Government Services wishes to be kept confidential, they should be filed in accordance with subsection 46(1) of the Canadian International Trade Tribunal Act.

The parties are directed to serve each other and the Canadian International Trade Tribunal simultaneously.
