IN THE MATTER OF a complaint filed by Winchester Division-Olin Corporation under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47;

AND FURTHER TO a determination made pursuant to section 30.16 of the Canadian International Trade Tribunal Act awarding the Department of Public Works and Government Services its reasonable costs incurred in relation to responding to the complaint, which costs are to be paid by Winchester Division-Olin Corporation.

ORDER

In a determination made on April 2, 2004, the Canadian International Trade Tribunal awarded the Department of Public Works and Government Services its reasonable costs incurred in relation to responding to the complaint.

On April 29, 2004, the Department of Public Works and Government Services submitted its claim for costs to the Canadian International Trade Tribunal in the amount of $2,466.42. On June 1, 2004, Winchester Division-Olin Corporation indicated to the Canadian International Trade Tribunal that it had no comments with respect to the submission made by the Department of Public Works and Government Services regarding its costs.

The Department of Public Works and Government Services claimed $2,466.42 for legal fees. This consisted of 37 hours at $66.66 per hour for work performed by its in-house counsel. It submitted that the rate of $66.66 per hour was in accordance with the Canadian International Trade Tribunal's ruling in its cost order in Antian Professional Services Inc. with respect to the appropriate rate for in-house counsel.

The Canadian International Trade Tribunal finds that this amount is reasonable. In consideration of the above, the Canadian International Trade Tribunal hereby allows the Department of Public Works and Government Services its costs in the amount of $2,466.42 for responding to the complaint and directs Winchester Division-Olin Corporation to take appropriate action to ensure prompt payment.
