IN THE MATTER OF a complaint filed by Wang Canada Limited under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), as amended;

AND IN THE MATTER OF a decision to conduct an inquiry into the complaint under subsection 30.13(1) of the Canadian International Trade Tribunal Act.

ORDER

In a determination made on March 11, 1998, the Canadian International Trade Tribunal (the Tribunal), pursuant to subsection 30.16(1) of the Canadian International Trade Tribunal Act, awarded Wang Canada Limited (Wang) its reasonable costs incurred in relation to filing and proceeding with its complaint.

Wang submitted to the Tribunal, on April 14, 1998, its claim for complaint costs in the amount of $9,092.56. On April 30, 1998, the Department of Public Works and Government Services (the Department) wrote to the Tribunal stating that it had no comments with respect to Wang’s claim.

Wang has claimed an amount of $8,137.40 or 83.1 hours, charged at rates ranging from $60 to $150, as legal fees (including GST) and an amount of $955.16 as disbursements. In considering Wang’s claim, the Tribunal had regard to the Procurement Cost Guidelines and considered, among other factors, the complexity of the complaint and the degree of experience and skill of counsel. The Tribunal is of the view that the hourly fees and hours charged, as well as the disbursements claimed, are reasonable and that Wang should be awarded the amounts claimed.

The Tribunal hereby awards Wang costs in the amount of $9,092.56 in relation to proceeding with its complaint and directs the Department to take appropriate action to ensure prompt payment.
