IN THE MATTER OF a complaint filed by Marathon Management Company under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), as amended;

AND IN THE MATTER OF a decision to conduct an inquiry into the complaint under subsection 30.13(1) of the Canadian International Trade Tribunal Act.

O R D E R

In a determination made on May 26, 1999, the Canadian International Trade Tribunal (the Tribunal) awarded Marathon Management Company (Marathon), pursuant to subsections 30.15(4) and 30.16(1) of the Canadian International Trade Tribunal Act, its reasonable costs incurred in relation to filing and proceeding with this complaint.

On June 15, 1999, the Department of Public Works and Government Services (the Department) wrote to the Tribunal stating its intention to implement fully the decision of the Tribunal. Marathon submitted to the Tribunal, on June 24, 1999, its claim for costs in the amount of $1,794.27 for filing and proceeding with its complaint. On July 19, 1999, the Department wrote the Tribunal stating that it had reviewed the claim made by Marathon and concluded that the amount of $1,794.27 was reasonable.

The Tribunal carefully reviewed the claim and is of the view that the costsclaimed by Marathon are reasonable in the circumstances. Therefore, the Tribunal hereby awards Marathon costs in the amount of $1,794.27 for filing and proceeding with its complaint and directs the Department to take appropriate action to arrange payment.
