IN THE MATTER OF a complaint filed by Service Star Building Cleaning Inc. under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), as amended;

AND IN THE MATTER OF a decision to conduct an inquiry into the complaint under subsection 30.13(1) of the Canadian International Trade Tribunal Act.

ORDER

In a determination made on January 22, 1999, the Canadian International Trade Tribunal (the Tribunal) awarded Service Star Building Cleaning Inc. (Service Star), pursuant to subsections 30.15(4) and 30.16(1) of the Canadian International Trade Tribunal Act, its reasonable costs incurred in preparing a response to the Request for Proposal (RFP) and in relation to filing and proceeding with its complaint.

On February 8, 1999, the Department of Public Works and Government Services (the Department) wrote to the Tribunal stating its intention to implement fully the Tribunal’s decision. Service Star submitted to the Tribunal, on February 22, 1999, its claim for costs in the amount of $13,241.91 for preparing its response to the RFP and $5,206.20 for filing and proceeding with its complaint. On March 16, 1999, the Department wrote to the Tribunal stating that the claim submitted by Service Star was reasonable. The Department stated, in its letter, that Service Star’s claim in relation to preparing a response to the RFP was $13,237.91. The Tribunal has assumed that this was an unintentional error.

The Tribunal, having considered, among other factors, the complexity of both the RFP and the complaint, the supporting documentation provided by Service Star and the position taken by the Department, is of the view that the claim is reasonable.

The Tribunal hereby awards Service Star costs in the amount of $13,241.91 for preparing its response to the RFP and $5,206.20 for filing and proceeding with its complaint and directs the Department to take appropriate action to ensure prompt payment of the total claim of $18,448.11.
