IN THE MATTER OF a complaint filed by TELUS Integrated Communications Inc. under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47;
AND IN THE MATTER OF a motion filed on July 7, 2000, by the Correctional Service of Canada for an order dismissing the complaint on the basis that the Canadian International Trade Tribunal does not have the jurisdiction to conduct an inquiry into the procurement because the procurement is not subject to the Agreement on Internal Trade.
ORDER
The Canadian International Trade Tribunal (the Tribunal) hereby dismisses the part of the motion pertaining to grounds A) and B). The Tribunal is the opinion that, as the Correctional Service of Canada is the procuring entity, the procurement does meet the monetary threshold indicated in the Agreement on Internal Trade and that the procurement is therefore covered by the Agreement on Internal Trade.
With respect to grounds C) and D) of the motion, the Tribunal directs the Correctional Service of Canada to include these arguments, with the required supporting information, in the Government Institution Report (GIR). Furthermore, the Tribunal directs the complainant to reply to these arguments in its response to the GIR.
Reasons for the dismissal of the part of the motion regarding grounds A) and B) will be addressed in the Tribunal's determination.
