IN THE MATTER OF a complaint filed by TAB Canada under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended;
AND IN THE MATTER OF a decision to conduct an inquiry into the complaint under subsection 30.13(1) of the Canadian International Trade Tribunal Act.
ORDER
The Canadian International Trade Tribunal hereby dismisses the portions of the complaint that relate to:
· the transaction described in the complaint as the acquisition of goods by the Department of Human Resources Development from CORCAN; and
· the application of the North American Free Trade Agreement and the Agreement on Government Procurement to the transaction described in the complaint as the acquisition of goods by CORCAN from Spacesaver Mobile Storage Systems Corporation (Spacesaver) pursuant to an exclusive agreement.
Further input will be sought with respect to the applicability of the Agreement on Internal Trade to the transaction between CORCAN and Spacesaver.
