ORDER

Having considered the motion dated March 13, 2006, filed by C2 Logistics Incorporated, the submissions dated March 17, 2006, from the Department of National Defence and from Skylink Aviation Inc., and the submissions dated March 20 and 21, 2006, from C2 Logistics Incorporated, the Canadian International Trade Tribunal orders, pursuant to subsection 17(2) of the Canadian International Trade Tribunal Act, that the Department of National Defence file with the Canadian International Trade Tribunal, on or before March 29, 2006, the following information relating to the designated contract awarded under Invitation to Tender—Operation AUGURAL—Deployment:

• details concerning what portion of the $3,402,432 paid to Skylink Aviation Inc. was for repositioning services and what portion was for demurrage services;

• all details relating to the payment of demurrage fees, including how demurrage fees were calculated (e.g. per aircraft, per day, number of days, number of aircraft);

• all details relating to the payment of repositioning fees; and

• all details concerning optional flights that occurred under the contract (i.e. origin, destination, cargo, dedicated or shared purpose flight).

If the submission contains information that the Department of National Defence wishes to be kept confidential, it should consult subsection 46(1) of the Canadian International Trade Tribunal Act and rule 15 of the Canadian International Trade Tribunal Rules and proceed accordingly.

The Canadian International Trade Tribunal also extends the date for the filing of the replies to the compensation submissions to April 5, 2006.
