IN THE MATTER OF a motion filed by Consortium Genivar - M3E - Université d'Ottawa, pursuant to rule 24 of the Canadian International Trade Tribunal Rules, with regard to the production of documents by the Canadian International Development Agency;

AND FURTHER TO a complaint filed by Consortium Genivar - M3E - Université d'Ottawa pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47.

ORDER

After having examined the request filed by Consortium Genivar - M3E - Université d'Ottawa, dated June 5, 2003, and the comments made by the Canadian International Development Agency (CIDA) and the intervener, Groupe Conseil CAC International inc. - Université de Sherbrooke, dated June 10, 2003, the Canadian International Trade Tribunal (the Tribunal) orders CIDA, pursuant to subsection 17(2) of the Canadian International Trade Tribunal Act, to file with the Secretary of the Tribunal, by Thursday, June 26, 2003, the following documents that relate to Solicitation No. SEL-2001-A-31398:

· A copy of the correspondence (mail, facsimile, e-mail) between CIDA's representatives and Ms. Esther Elkrieff concerning her contacts with the planners of the PRODEJ Implementation Support Project (the second support project);

· A copy of the complete reports prepared by Mr. El Obaid A. El Obaid concerning the second support project and a copy of the notes and minutes of meetings held with Ms. Elkrieff, including Mr. El Obaid's notes;

· A copy of the minutes of the committee that evaluated the proposals submitted for the second support project, including a copy of any communications that would have taken place outside the committee regarding the eligibility of the group with which Ms. Elkrieff is associated;

· A true signed copy of the individual ratings given to the submissions by each member of the committee that evaluated the proposals submitted for the second support project; and

· A copy of the reference documents for the projects of the group chosen by CIDA for the procurement at issue.
