Having considered the motion by Microsoft Canada Co., Microsoft Corporation, Microsoft Licensing, GP and Softchoice Corporation dated December 16, 2009, the comments by the Department of Public Works and Government Services dated December 23, 2009, the comments made by the intervener in this matter, Sierra Systems, dated December 23, 2009, and the reply by Microsoft Canada Co., Microsoft Corporation, Microsoft Licensing, GP and Softchoice Corporation dated December 30, 2009, the Canadian International Trade Tribunal, pursuant to subsection 17(2) of the Canadian International Trade Tribunal Act, orders the Department of Public Works and Government Services to file with the Secretary of the Tribunal, by January 11, 2010, the following documents:
those portions of the Unified Portal Software Solution contract (contract No. EP265-04H009/001/ET) between the Department of Public Works and Government Services and Sierra Systems Group Inc., as well as any amendments or call-ups to that contract, that relate to the rights and entitlements of the Department of Health to the software solution provided by Sierra Systems Group Inc., including the Oracle Collaboration Suite and future developments thereto; and
any presentations or analyses prepared by the Department of Public Works and Government Services that relate to the e-mail functionality abilities of the Oracle Collaboration Suite and Oracle Beehive.
