IN THE MATTER OF a complaint filed by EDUCOM Training Systems Inc. under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47;

AND IN THE MATTER OF a motion by the Department of Public Works and Government Services under rule 24 of the Canadian International Trade Tribunal Rules for an order dismissing the complaint on the basis that it was not filed within the time limits established by section 6 of the Canadian International Trade Tribunal Procurement Inquiry Regulations;

AND IN THE MATTER OF a cross-motion by EDUCOM Training Systems Inc. to have the case decided on the basis of the existing record.

O R D E R

The Canadian International Trade Tribunal hereby dismisses the motion by the Department of Public Works and Government Services and the cross-motion by EDUCOM Training Systems Inc.
