IN THE MATTER OF a complaint filed by Heddle Marine Service Inc. pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.);

AND FURTHER TO a decision of the Canadian International Trade Tribunal to conduct an inquiry into the complaint pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act;

AND FURTHER TO a request by Chantier Davie Canada Inc. for intervener status;

AND FURTHER TO a motion by the Department of Public Works and Government Services to dismiss the complaint pursuant to subsection 10(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations;

AND FURTHER TO the withdrawal of the complaint by Heddle Marine Service Inc.

BETWEEN

AND

THE DEPARTMENT OF PUBLIC WORKS AND GOVERNMENT SERVICES

ORDER

WHEREAS Heddle Marine Service Inc. filed the above-mentioned complaint on August 22, 2019;

AND WHEREAS the Canadian International Trade Tribunal, on August 29, 2019, decided to inquire into the complaint pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act and subsection 7(1) of the Canadian International Trade Tribunal Procurement Inquiry Regulations;

AND WHEREAS Chantier Davie Canada Inc. requested intervener status on September 6, 2019;

AND WHEREAS the Department of Public Works and Government Services, on September 6, 2019, filed a motion to dismiss the complaint pursuant to subsection 10(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations;

AND WHEREAS Heddle Marine Service Inc. withdrew its complaint on September 17, 2019;

AND WHEREAS subsection 30.13(5) of the Canadian International Trade Tribunal Act provides that the Canadian International Trade Tribunal may cease conducting the inquiry;

AND WHEREAS it is appropriate for the Canadian International Trade Tribunal to cease conducting the inquiry in the present circumstances;

THEREFORE, pursuant to subsection 30.13(5) of the Canadian International Trade Tribunal Act, the Canadian International Trade Tribunal hereby ceases its inquiry.

AND, THEREFORE, the request for intervener status filed by Chantier Davie Canada Inc. and the motion to dismiss filed by the Department of Public Works and Government Services are hereby declared moot as a result of the cessation of the inquiry.
