IN THE MATTER OF a complaint filed by Falcon Environmental Inc. pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.);

AND FURTHER TO a motion filed by Falcon Environmental Inc. on July 27, 2020, seeking an order directing the Department of Public Works and Government Services to produce certain documents.

ORDER

Having considered the motion by Falcon Environmental Inc. (Falcon) filed on July 27, 2020, the comments by the Department of Public Works and Government Services (PWGSC) dated July 31, 2020, the submissions by the intervener Pacific Northwest Raptors Ltd. (Pacific) dated July 31, 2020, and the additional comments filed by Falcon on August 5, 2020, the Canadian International Trade Tribunal hereby grants, in part, the motion filed by Falcon and orders that PWGSC produce the following documents:

  1. The unabridged bid of Pacific;

  2. All correspondence and communications following bid closing between the technical evaluators and the contract authority used for the evaluation and re-evaluation of proposals against mandatory technical criterion M2 and point-rated technical criterion R1, including any specific guidelines used for the evaluation of Pacific’s bid against these criteria; and

  3. All correspondence and communications between the technical evaluators, the contract authority and third parties following Falcon’s objection related to efforts undertaken to verify the information contained in Pacific’s bid in order to demonstrate compliance with mandatory technical criterion M2 and point-rated technical criterion R1.

All documents shall be filed with the Tribunal by Thursday, August 13, 2020, or any other date prescribed by the Tribunal.
