IN THE MATTER OF a complaint filed by Niagara Consulting, Inc. pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.);

AND FURTHER TO a decision of the Canadian International Trade Tribunal to conduct an inquiry into the complaint pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act;

AND FURTHER TO the withdrawal of the complaint by Niagara Consulting, Inc.

ORDER

WHEREAS the above-mentioned complaint was filed on December 22, 2020, by Niagara Consulting, Inc.;

AND WHEREAS the Canadian International Trade Tribunal decided, on December 31, 2020, to inquire into the complaint, pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act (CITT Act) and subsection 7(1) of the Canadian International Trade Tribunal Procurement Inquiry Regulations;

AND WHEREAS, on January 4, 2021, the Tribunal ordered, pursuant to subsection 30.13(3) of the CITT Act, that the Department of Public Works and Government Services postpone the award of any contract in connection with the current procurement until the Tribunal determined the validity of the complaint;

AND WHEREAS, on January 8, 2021, Niagara Consulting, Inc. informed the Tribunal that it was withdrawing its complaint;

AND WHEREAS subsection 30.13(5) of the CITT Act provides that the Tribunal may cease conducting the inquiry;

THEREFORE, pursuant to subsection 30.13(5) of the CITT Act, the Tribunal hereby ceases its inquiry.

AND, THEREFORE, the postponement of award of contract order issued on January 4, 2021, is hereby rescinded. Each party will bear its own costs in this matter.
