IN THE MATTER OF a complaint filed by Inventa Sales & Promotions pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.);

AND FURTHER TO a decision of the Canadian International Trade Tribunal, pursuant to subsections 30.15(2) and (3) of the Canadian International Trade Tribunal Act, recommending that Inventa Sales & Promotions be compensated by an amount equal to the costs it reasonably incurred in preparing its bid for Solicitation No. K1A30-210980/A.

ORDER

The Canadian International Trade Tribunal hereby endorses the agreement between the parties that the Department of Public Works and Government Services compensate Inventa Sales & Promotions in the amount of $30,081.50, which represents the costs that it reasonably incurred in preparing its bid for the subject solicitation. The Tribunal directs the Department of Public Works and Government Services to take the appropriate action to ensure prompt payment.

Each party will bear its own costs in relation to these proceedings.

STATEMENT OF REASONS

[1] In its decision dated August 24, 2021, the Canadian International Trade Tribunal, pursuant to subsection 30.15(4) of the Canadian International Trade Tribunal Act, [1] awarded Inventa Sales & Promotions (Inventa) its reasonable costs incurred in preparing its bid, in the event that its security clearance was found on re-evaluation to be non-compliant with mandatory criterion M5 of Solicitation No. K1A30-210980/A.

[2] On November 9, 2021, Inventa submitted its claim for bid preparation costs to the Tribunal. Inventa sought $30,081.50 in compensation for its bid preparation costs and related expenses.

[3] On November 18, 2021, the Department of Public Works and Government Services (PWGSC) filed its submission. PWGSC consented to Inventa’s proposal and provided confirmation that it would make arrangements to pay Inventa the amount it requested.

[4] Given that the parties agree to the amount of bid preparation costs and seeing that the submissions comply with the Procurement Costs Guideline, [2] the Tribunal sees no reason to vary this amount and therefore hereby endorses the agreement reached between the parties.

[5] Pursuant to subsection 30.15(4) of the CITT Act, the Tribunal hereby awards Inventa compensation in the amount of $30,081.50, which represents the reasonable costs it incurred in preparing its bid, and directs PWGSC to take appropriate action to ensure prompt payment.

[6] Each party will bear its own costs in relation to these proceedings.
