IN THE MATTER OF a complaint filed by Gregory Kerr Limited pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act;

AND FURTHER TO the Canadian International Trade Tribunal’s preliminary indication of the level of complexity for the complaint case.

BETWEEN

GREGORY KERR LIMITED

AND

THE DEPARTMENT OF PUBLIC WORKS AND GOVERNMENT SERVICES

Government Institution

ORDER

In its reasons of May 10, 2022, the Canadian International Trade Tribunal, pursuant to section 30.16 of the Canadian International Trade Tribunal Act, awarded the Department of Public Works and Government Services (PWGSC) its reasonable costs incurred in responding to the complaint. The Tribunal’s preliminary indication of the level of complexity for the complaint case was Level 1. Gregory Kerr Limited (GKL) concurred with the Tribunal’s preliminary determination that costs be awarded at Level 1 of the Procurement Costs Guideline. PWGSC did not make representations. Accordingly, the Tribunal confirms its preliminary indication by awarding PWGSC its costs in the amount of $1,150, i.e. the flat rate associated with a level of complexity of Level 1, for responding to the complaint and directs GKL to take appropriate action to ensure prompt payment.
