DECISION
Pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act, the Canadian International Trade Tribunal has decided not to conduct an inquiry into the complaint. For reasons that will be explained in greater detail shortly, the Tribunal does not have the jurisdiction to review, or inquire into, the operational and policy decisions complained of by Avro Bourdeau Aerospace Corp. (Avro Bourdeau) with respect to procurement for the Future Fighter Capability Project (FFCP). With respect to the conduct of the solicitations relevant to the FFCP, the Tribunal previously received a complaint from Avro Bourdeau and pronounced its final decision on the matter. It cannot now lawfully reopen or revisit that decision.
