IN THE MATTER OF a complaint filed by Ashby Laundromat Ltd. (Ashby) pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act (the Act);

AND FURTHER TO a decision to conduct an inquiry into the complaint pursuant to subsection 30.13(1) of the Act and subsection 7(1) of the Canadian International Trade Tribunal Procurement Inquiry Regulations;

AND FURTHER TO the withdrawal of the complaint by Ashby.

ORDER

WHEREAS Ashby filed the above‑mentioned complaint on November 30, 2023, and December 4, 2023, in relation to a request for proposal (solicitation 30004841) issued by the Department of Fisheries and Oceans (DFO) for the provision of laundry and dry‑cleaning services in support of the Canadian Coast Guard College;

AND WHEREAS, on December 11, 2023, the Canadian International Trade Tribunal decided to inquire into the complaint;

AND WHEREAS, on December 15 and 21, 2023, DFO acknowledged that an error was made during the course of the evaluation process, undertook to reissue the solicitation and asked that the Tribunal cease its inquiry;

AND WHEREAS, on December 21, 2023, DFO notified Ashby and the Tribunal that the expected timeline for re-issuance of the solicitation was mid‑January 2024;

AND WHEREAS, on December 21, 2023, Ashby notified the Tribunal that it was satisfied with the solution offered by DFO and that it was withdrawing its complaint;

THEREFORE, pursuant to subsection 30.13(5) of the Act, the Tribunal ceases its inquiry.

Each party will bear its own costs.
