DECISION

Galaxy Information Systems (Galaxy) filed a complaint that relates to a solicitation for the supply of Network Management Training (NMT) services by the Department of National Defence (DND) for the Canadian Armed Forces in Jerusalem.

The Canadian International Trade Tribunal has decided not to conduct an inquiry into the complaint, pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act.

Even if the Tribunal were to assume that:

  • A ground of complaint was filed within the time limits set out in section 6 of the Canadian International Trade Tribunal Procurement Inquiry Regulations (Regulations);

  • The World Trade Organization-Agreement on Government Procurement (WTO-GPA) is applicable, given Galaxy’s place of business; or

  • This solicitation of NMT is not excluded under Canada’s Annex 5 (Services) to Appendix 1 of the WTO-GPA

given that the contract value awarded to the winning bidder is significantly lower than the monetary threshold set for DND’s procurement on services for the period of January 1, 2024, to December 31, 2025, in accordance with Canada’s Annex 1 (Central Government Entities) to Appendix 1 of the WTO-GPA, the Tribunal finds that Galaxy’s complaint is not in respect of a designated contract, pursuant to subsection 7(1)(b) of the Regulations.
