DETERMINATION
Upon reviewing the evidence and materials filed, and for more detailed reasons to follow, the Canadian International Trade Tribunal concludes as follows:
(1)The evaluation of the bid submitted by ADGA Group Consultants Inc. (ADGA) for Workstreams 3 and 5 of the solicitation at issue was reasonable, having regard to the deferential standard of review that the Tribunal is required to apply.
(2)ADGA’s grounds for complaint that the bid of the successful bidder for Workstreams 3, 4 and 5 should have been disqualified are, on the facts of this case, matters of contract administration, which falls outside the Tribunal’s jurisdiction.
Accordingly, and pursuant to subsection 30.14(2) of the Canadian International Trade Tribunal Act (CITT Act), the Tribunal determines that the complaint is not valid.
Pursuant to section 30.16 of the CITT Act, the Tribunal may make an award of costs. The parties may make submissions on costs within 15 days of the issuance of the Tribunal’s statement of reasons.
