DECISION

Make A Move Life Counselling’s complaint relates to a procurement by the Department of Public Works and Government Services, on behalf of the Canada Border Services Agency, for the solicitation of professional medical services for immigration detainees.

The Canadian International Trade Tribunal has decided not to conduct an inquiry into the complaint pursuant to subsection 30.13(1) of the Canadian International Trade Tribunal Act (CITT Act).

The Tribunal finds that the complaint was not filed within the time limits prescribed by section 6 of the Canadian International Trade Tribunal Procurement Inquiry Regulations (Regulations). The Tribunal also finds that the complaint is not in respect of a designated contract within the meaning of section 30.1 of the CITT Act and paragraph 7(1)(b) of the Regulations because the services being procured constitute health services, which are not covered under the applicable trade agreements.
